This'n'That; November 30th[Injuns;Honeymoon]

See What Happens.......?? The Oneida Indian Nation [central-upstate New York] is prospering outside the fascist contrivances of the State of New York and obamanomics. So prosperous that they're able to award their employees a share of 5.1 Million dollars in bonus pay-outs. The bonus checks will average just under $1,181.00-a great start to the upcoming holidays!! This industrious group has several profit centers in their organization:
  • The "Turning Stone" Resort and Casino.
  • Car Care; which has full service maintenance facilities, car wash, detailing.
  • The Towers; a 17 story [high end] hotel.
  • Salmon Acres; 9 rustic cabins, literally at the water's edge of Oneida Lake.
  • The Hotel; Classic style amenities, various rooms have high end amenities.
  • The Inn; On the casino grounds, 62 affordably priced rooms.
  • The Villages RV Park; 175 paved sites, full-service hookups, wireless internet.
The Oneida as an organization, is a prime example of what can happen when either the government gets "the-Hell-outta-the-way" or the government has no authority. We should hope that the "pay czar" has no authority over tribal lands!! Is The "Honeymoon" Over?? obamatics [Fluffy obama's version of fascist politics] is all about getting the greatest number of morons to believe the greatest amount of bullshit!! Fluffy and his handlers "bought" the presidency because they were better bullshitters than McCain/Palin. The pre-election obamanation thought they had a young, talented, well educated idealist who spread that "hope-and-change" thing on pretty heavily. Those conservative folks who could, and can think for themselves, saw the "Clown Prince" for what he proved to be: a purveyor of "Chicago politics" as usual; someone far more liberal that he let on!! With the upcoming first anniversary of the purchase, the "Clown Prince's" house-of-cards is beginning to fall; the KoolAid media is beginning to assert some of their observations into the fluffpieces they write about him.
He Thinks He’s Playing With "Monopoly Money"
Everyone he relies upon to do his thinking for him, urged him on to spend thousands of millions of dollars. They failed to remember that-regardless of the number of KoolAid Drinkers-a majority of Americans can and do think for themselves. The "Clown-thinkers" just figured that everyone would just fall in line and support the federal pissing away of the largess!! Fluffy and his thinkers are realizing that there are consequences to their actions, MOSTLY NEGATIVE!! Not only the disasterous financial decisions the thinkers made, they failed to realize that independents were, for a time, KoolAid Drinkers. The KoolAiders are deserting him in droves as indicated by the elections in Virginia and New Jersey. These two elections, combined with public alarm over unnecessarily big government and outrageous spending, combined with his plummeting job performance numbers [56%-very negative], indicate that the "Honeymoon" IS OVER!!
Too Much "Leonard Nimoy"
While the "Clown Prince," as an inexperienced legislator, is fluent in describing the nuances of problems; he's intellectually are detached from rock-bottom principles. Both Maureen Dowd in The New York Times and Joel Achenbach of The Washington Post have likened him to Star Trek’s Mr. Spock. The Spock imagery was visible during his extended review of Afghanistan policy. He’ll announce the results during his "West Point Photo-Op" Tuesday night. The speech’s success will be judged not only on the logic of the presentation but on whether obama communicates in a profound way what progress looks like and why it is worth achieving. No soldier wants to take a bullet in the name of nuance, or a "photo-op," for that matter!!
That’s The "Chicago Way"
Nearly all the "Clown Prince's" minions are street thugs he associated himself with during his "community agitator years." In a Washington Post story this month, White House deputy chief of staff Jim Messina, referring to most of Fluffy’s team, said, “We are all campaign hacks.” The problem is that many voters mistakenly took obama seriously in 2008 when he talked about wanting to create a more reasoned, non-partisan style of governance in Washington. When RepublicRATs showed scant interest in cooperating with Obama at the start, the Obama West Wing gladly reverted to campaign hack mode. The examples of Chicago-style politics include their delight in public battles with Rush Limbaugh and Fox News and the U.S. Chamber of Commerce. (There was also a semi-public campaign of leaks aimed at Greg Craig, the White House counsel who fell out of favor.)
In private, the obama handlers cut an early deal—to the distaste of many congressional obamacRATs—with favorable terms to the pharmaceutical lobby in exchange for their backing his health care plans.
The lesson that many insiders learned is that the "Clown Prince" wants to buy off the people he can and bowl over those he can’t. This flies in the face of his handlers' branding of Fluffy as a new style of political leader.

He’s A Pushover

That the "Clown Prince" is a pansy is a perception that began when he several times laid down "lines-in-the-sand"--only to let people cross them with impunity.
  • Last summer he told obamacRATs they better not go home for recess until a critical health care vote but they blew him off.
  • He told the Israeli government he wanted a freeze in settlements but no one took him seriously.
  • Even
Fox News — which his aides prominently said should not be treated like a real news organization — then got interview time for its White House correspondent.
  • In truth, most of these episodes do not amount to much. But this unflattering storyline would take a more serious turn if Obama is seen as unable to deliver on his stern warnings in the escalating conflict with Iran over its nuclear program.
  • He sees America as another pleasant country on the U.N. roll-- somewhere between Albania and Zimbabwe.
  • But it highlights a continuing reality: In presidential politics the safe ground has always been to be an American exceptionalist.
Politicians of both parties have embraced the idea that this country—because of its power and/or the hand of Providence—should be a singular force in the world. Fluffy shows time and again, he's comfortable with a relative decline in U.S. influence and position in the world.
    The "
left" view: Fluffy has retreated from human rights in the name of cynical realism. The "right" [and correct] view: Fluffy is more interested in being President of the World than President of the United States!! This will be no more visible than in December as he stops in Oslo to pick up his Nobel Prize and then in Copenhagen for an international summit on the global warming hoax, even as that unravels!!
    President Pelosi
Nancy Porklosi has had far more success in office than the "Clown Prince" has, despite her public approval ratings dropping below a 35% "favorable" rating!! She has passed:
    • a version of the stimulus bill largely written by congressional obamacRATs,
    • passed climate legislation,
    • passed her chamber’s version of health care reform.
    • She is clearly affecting the White House’s Afghanistan calculations.
It's obvious that Porklosi’s achievements are more impressive than Fluffy’s, pending the final outcome of obamaCare. The speaker of the house is clearly more than Fluffy's equal!!
He’s In Love With The Man In The Mirror
The "Clown Prince" clearly loves no one else as much as he loves HIMSELF!! Everything is about the next photo-op. No one loves the camera more than he:
    • He gives interviews on his sports obsessions to ESPN.
    • cracks wise with Leno and Letterman.
    • discusses his fitness with Men’s Health.
    • discusses his marriage in a joint interview with first lady Michelle "The Chin" obama for The New York Times.
    • A photo shows him leaving the White House with a copy of GQ featuring.... wait-for-it........... HIMSELF!!!
With the novelty of a new president quickly wearing off, the "Clown Prince's" cult personality is revealed as mere vanity!! Til Nex'Time....

    This'n'That; December 1st[TortReform;obamaCare]

Two definitions: Tort reform refers to proposed changes in the civil justice system that would reduce tort litigation or damages. Tort is a system for compensating wrongs and harm done by one party to another's person, property or other protected interests (e.g. reputation, under libel and slander laws). Medical malpractice is professional negligence by act or omission by a health care provider in which care provided deviates from accepted standards of practice in the medical community and causes injury or death to the patient. Standards and regulations for medical malpractice vary by country and jurisdiction within countries. Medical professionals are required to maintain professional liability insurance to offset the risk and costs of lawsuits based on medical malpractice. A recent study by Healthgrades found that an average of 195,000 hospital deaths in each of the years 2000, 2001 and 2002 in the U.S. were due to potentially preventable medical errors.
    • Researchers examined 37 million patient records and applied the mortality and economic impact models developed by Dr. Chunliu Zhan and Dr. Marlene R. Miller in a study published in the Journal of the American Medical Association (JAMA) in October 2003.
    • The Zhan and Miller study supported the Institute of Medicine’s (IOM) 1999 report conclusion, which found that medical errors caused up to 98,000 deaths annually and should be considered a national epidemic.
    • Some researchers questioned the accuracy of the study, reporting both significant subjectivity in determining which deaths were "avoidable" or due to medical error and an erroneous assumption that 100% of patients would have survived if optimal care had been provided.
    • A 2001 study in JAMA estimated that only 1 in 10,000 patients admitted to the hospital would have lived for 3 months or more had "optimal" care been provided.

A 2006 follow-up to the 1999 Institute of Medicine study found that medication errors are among the most common medical mistakes, harming at least 1.5 million people every year.

    • 400,000 preventable drug-related injuries occur each year in hospitals, 800,000 in long-term care settings, and roughly 530,000 among Medicare recipients in outpatient clinics. The report stated that these are likely to be conservative estimates.
    • In 2000 alone, the extra medical costs incurred by preventable drug related injuries approximated $887 million – and the study looked only at injuries sustained by Medicare recipients, a subset of clinic visitors. None of these figures take into account lost wages and productivity or other costs. Most (73%) settled malpractice claims involve medical error.
    • A 2006 study published in the New England Journal of Medicine concluded that claims without evidence of error "are not uncommon, but most [72%] are denied compensation.
    • The vast majority of expenditures [54%] go toward litigation over errors and payment of them. The overhead costs of malpractice litigation are exorbitant."
Physicians examined the records of 1452 closed malpractice claims.
    • Ninety-seven percent were associated with injury; of them, 73% got compensation.
    • Three percent of the claims were not associated with injuries; of them, 16% got compensation.
    • 63% were associated with errors; of them, 73% got compensation (average $521,560).
    • Thirty-seven percent were not associated with errors; of them, 28% got compensation (average $313,205).
    • Claims not associated with errors accounted for 13 to 16% percent of the total costs.
For every dollar spent on compensation, 54 cents went to administrative expenses (including lawyers, experts, and courts). Claims involving errors accounted for 78 percent of administrative costs. Prior to 1975, the State of California experienced astronomical increases in malpractice tort expense as well as malpractice insurance expense. Then, along comes MICRA!! When it is impossible to sue the HMO directly, as when it is protected by ERISA, it may be possible to sue a negligent treating doctor for medical malpractice, and hold the HMO vicariously liable for the doctor's actions. The Medical Injury Compensation Reform Act of 1975 (MICRA) limits damages recoverable in medical malpractice suits as follows: $250,000 cap on non-economic damages CC sec. 3333.2 says that in any action against a health care provider for professional negligence, non-economic damages, eg: for pain and suffering, may not exceed $250,000. This may make it hard to get a lawyer interested in the case. Collateral Source Rule abrogated In most tort cases the common law "Collateral Source Rule", makes it reversible error for the defendant to tell the jury how much of your damages have been paid by someone else, eg: an insurer, family member, etc. However, CC sec. 3333.1 lets them tell the jury in MedMal cases, encouraging the jury to cut your recovery by that amount. Installment Payments CCP sec. 667.6 allows future damages over $50,000 to be paid in installments instead of a lump sum, with the payments to stop if the plaintiff dies. This is a disadvantage to the plaintiff and his family, as the annuity is much cheaper than the lump-sum would be. Punitive Damages The initial complaint cannot ask for punitive damages. Under CCP sec. 425.13, a separate motion must be made at the earlier of 2 years after filing or 9 months before the first scheduled trial date, showing a substantial probability that you'll prevail. Other ways MICRA attempts to inhibit Malpractice suits:
    • 90 day notice before filing suit.
    • Statute of Limitations. Suit must be filed within one year from the discovery of an injury and within three years from injury.
    • Limits on lawyers contingency fees:
    1st $50K: 40% next $50K: 33.33 % next $500K: 25% everything over $600K: 15%
In the non-medical arena, I found these lawsuits in an advertising email from LegalZoom [ www.legalzoom.com ]. After reading these, I find it difficult to understand why federal and state legislators never consider tort reform. ****I forgot, 95% of legislators ..............ARE LAWYERS!!!****
    • 5. A Grilled Chicken Blunder You never know what will result from the promise of free food. At least until you don't come through with said promised food. When Oprah and Kentucky Fried Chicken partnered to give Americans some free grilled chicken and ran out, more than a few feathers were ruffled. People were hungry and angry. For full disclosure, I was actually one of them. I blogged about it, then let it go. However, some took their displeasure to a higher level. James Asanuma and Veronica Mora filed suit against KFC. According to an article in the Los Angeles Times, "[T]he complaint accuses KFC of false advertising, fraud and unfair business practices" and using the promotion to get customers to spend money when they had not planned to. The original lawsuit was in Los Angeles Superior Court, but it's been removed to Federal court and could be gearing up for class action status.
    • 4. A Really Bitter Divorce It's no surprise to most of us, that despite the "until death do us part" pledge, many marriages end in divorce. However, it is rather surprising when a husband who gave his wife a kidney asks for it back or its monetary equivalent. Especially when the husband is a surgeon. That's what happened to the Batistas, according to an article on newsday.com. In 2001, Dr. Richard Batista freely gave his wife a kidney. His wife, Dawnell, a nurse, filed for divorce in 2005. And in 2009, her ex-husband changed his mind about the freely given part as it related to his kidney. The Newsday story indicates that Dr. Batista is facing an uphill battle. "Arthur Caplan of the University of Pennsylvania's Center for Bioethics said the likelihood of Batista getting either his kidney or cash was 'somewhere between impossible and completely impossible.'"
    • 3. Lawsuits 101 Many people consider it an honor to be listed in the Guinness Book of World Records. But not Jonathan Lee Riches, aka Irving Picard. According to Abcnews.com, he was about to be listed as the most litigious man in the world. Riches, who is currently serving a sentence in federal prison in Kentucky for wire fraud, has filed thousands of lawsuits. Riches didn't like the prospect, so, unsurprisingly, he sued Guinness to keep from listing his name. According to the article, Riches is scheduled to be released in March 2012, but could be released into a halfway house as soon as the summer of 2010. And what are his plans upon release? "I'm going to start a lawsuit 101 shop and teach Americans how to file (pro se) lawsuits." He also plans to sell T-shirts that say "Watch what you do or I'll sue you."
    • 2. Disney's Tower of Terror Not everyone likes amusement park rides, but according to Central Florida News 13, Denise Mooty needs them. And not just any amusement park ride, but specifically Disney World's Tower of Terror. Mooty apparently suffers from a very painful condition caused by abdominal adhesions. Somehow she has found that this particular ride is the one thing that alleviates her suffering. Her doctor agrees that the way the ride drops, causes the scar tissue to break up and allow her to move more freely. Mooty purchased an annual pass to Disney, so that she could use the ride repeatedly. She alleged that Disney employees detained her and would not let her use the ride as needed. Mooty sued Disney for Breach of Contract, Intentional Infliction of Emotional Distress, and False Arrest.
    • 1. Hallmark v. Hilton - How Hot? The number one spot may make you shake your head, laugh, and maybe even walk away puzzled at the same time. It's about Paris Hilton and a birthday card. An article on The Business Insider, states that apparently Hallmark was intrigued by Hilton's (literally) trademarked phrase "that's hot" and used it along with an image of her - both without her permission. In a recent Opinion, the Court stated "We must decide whether California law allows a celebrity to sue a greeting card company for using her image and catchphrase in a birthday card without her permission." Well, that panel of 9th Circuit Judges decided that Hilton's lawsuit against Hallmark can go forward. So if you thought that you would not hear about Paris Hilton in the New Year, sadly, you will have to think again.

In essence, SOME lawsuits are necessary, be they to secure future financial support or to curtail hazardous activity, products. What must be reformed is the monetary awards, thereto. Like so many product liability suits we've seen in the tobacco industry, most torts are awarded seemingly astronomical monies for a death or dismemberment or disability. Even if I were the plantiff, I see no earthly reason why one should be awarded multi-millions in a death case; it won't bring the deceased back, nor will it result in the perpetrator getting "his pee-pee whacked" financially!! Take the Ford Rollover Case: It wasn't even filed by those who may have been injured or suffered a financial loss due to a vehicle rollover!!

A California judge approved the settlement of a class-action lawsuit that will compensate about 800,000 Ford Explorer owners whose vehicles lost value because of a perceived rollover danger. This rollover litigation wasn’t filed by people who were physically injured in accidents due to the Explorer’s alleged propensity to rollover, but people who claimed the resale values of their Explorers were hurt by news of the rollover problems and high-profile accidents. The settlement ends lawsuits against Ford Motor Co. in California, Connecticut, Illinois and Texas. Those lawsuits claimed that Explorers lost about $1,000 in resale value because of publicity stemming from a series of rollover accidents involving the SUV. The class action over the loss in value is separate from the numerous death and personal-injury lawsuits involving earlier models of the Explorer that continue across the country.

    • Under the settlement, those who bought Explorers in model years 1991 through 2001 are eligible for $500 vouchers to buy new Explorers or $300 vouchers to buy other Ford or Lincoln Mercury vehicles.
    • Consumer groups and some plaintiffs objected to the settlement. They said few owners will be able to take advantage of the vouchers, in part because of the poor economy and high gas prices.
    • They also were upset the plaintiffs' attorneys will receive as much as $25 million in fees and costs.
    • "They get $25 million. All I get is this lousy coupon that I'm not going to use. It's valueless to me," said plaintiff Stephen Webber of Glendale, Ca., who owns a 1993 Explorer.

The cruix of all this is....... the "Clown Prince's" obamaCare is all about control, practically nothing about health care expenses. If Fluffy obama had the public's finances at heart, he would have promoted both tort reform and health care insurance reform!! In the aforementioned "Ford case," the total award was $28Million..... the lawyers got 89.3% of the total!! In the aforementioned health care issues, tort reform would mathematically reduce the nationwide expense, simply by "removing pigs from the trough!!" Insurance reform will reduce an individual's annual care expense, initially by allowing the consumer to shop his coverage across state lines!! With health insurance treated like auto insurance, one could choose comparable coverage with the lowest premium without regard to which state it was offered in!!

Does the public realize that--if obamaCare becomes law as written--EVERYTHING in EVERY walk of life can be deemed as affecting one's health, thus be regulated and/or taxed by the government:

    • The car you drive: If you drive a gas-guzzlin' SUV, MORE TAXES; the vehicle is hazardous to the public health.
    • The food you eat: If you eat at McDonald's or another "greasy spoon," MORE TAXES; all the fat and carbs are a health hazard.
    • The house you live in: If it's a colonial, MORE TAXES; the stairs are a prime location for accidental falls.
    • The apartment you live in: The elevators you use to get to the 17th floor, MORE TAXES; using elevators require less activity than using stairs-even though stairs are more hazardous.
    • The job you have: If it's high-paying, MORE TAXES; taxes over and above those on the income-with high bonuses or salaries, you're taking money away from those who really need it [read: welfareRATs!!].
    • The movies you see: If you like those Psy-Fi thrillers, MORE TAXES; they raise the heart rate and blood pressure to high levels, increasing momentary stress-thus may bring on heart attacks.
    • The movies you see: If you like those action-dramas, MORE TAXES; that genre will likely cause the viewer to be more aggressive-putting the public at risk.

See how this works-there's NOTHING that can not be regulated under the guise of "health care!!!"

    Til Nex'Time....

"Clown Prince" Weekly Blather; November 28th

A Patriotic Response To the "Clown Prince; 11/28/09 Weekly Address; Thursday, November 26, 2009 For centuries, in peace and in war, in prosperity and in adversity, Americans have paused at this time of year to gather with loved ones and give thanks for life’s blessings. This week, we carry on this distinctly American tradition. All across our country, folks are coming together to spend time with family, to catch up with old friends, to cook and enjoy a big dinner – and maybe to watch a little football in between. As always, we give thanks for the kindness of loved ones, for the joys of the previous year, and for the pride we feel in our communities and country. We keep in our thoughts and prayers the many families marking this Thanksgiving with an empty seat – saved for a son or daughter, or husband or wife, stationed in harm’s way. And we say a special thanks for the sacrifices those men and women in uniform are making for our safety and freedom, and for all those Americans who enrich the lives of our communities through acts of kindness, generosity and service. [What I'm not telling you: While I make all the "appropriate noises," the American family is not the concept I'm promoting no do I want it to prevail. As you can see as you look around your communities, the obamacRATs of previous eras and generations as well as my own, have been quite successful in destroying-if not the concept, at least the practice-of "the American family!" While I publically decry the ever increasing unemployment rate [currently at a 26-year high of 10.2%, with the state record holder-Michigan at 15.1%!! {statistics that privately, I'm quite proud of!!} and the total unemployment rate-thankfully, NOT widely reported-is 17.5%, the highest recorded level in the modern era] it does work to my advantage. With the advent of "Slick-Willie's" so-called welfare reform of 1994; we fascists have a tool with which to advance our philosophies. No one has come up with a statistical category which combines the SSI numbers with the actual welfare recipient numbers-Thank Muhammad!!! Keeping them separated allows me to advance each segment by fractional rates, keeping the total number of recipients "under-the-radar." With all my programs combined-the continued failing economy, the SSI increases combined with the welfare increases-all but seal the fate of "the American family." This structural destruction makes the advancement of fascism practically "a-walk-in-the-park!!"]But as much as we all have to be thankful for, we also know that this year millions of Americans are facing very difficult economic times. Many have lost jobs in this recession – the worst in generations. Many more are struggling to afford health care premiums and house payments, let alone to save for an education or retirement. Too many are wondering if the dream of a middle class life – that American Dream – is slipping away. It’s the worry I hear from folks across the country; good, hard-working people doing the best they can for their families – but fearing that their best just isn’t good enough. These are not strangers. They are our family, our friends, and our neighbors. Their struggles must be our concern. [What I'm not telling you: As "in-the-bag" as they are, the KoolAid media will eventually make this economy--the obamaconomy. No longer will I be able to whine that I inherited it from "Dub'ya;" that it's all his fault!! Have you figured out that all these programs that the Congressional Moron Caucus are foisting upon you "under the cover of darkness" are all interlocked?? I've gotten you to fight amongst each-other over obamaCare; over Cap-and-Trade; over the economy, all for the benefit of fascism!! The obamaCare bill allows for the further destruction of Medicare/Medicaid with budget cuts; allows for federal support/funding of abortions; allows for future amendments which will bring in those 'Palin-esque' Death Panels, among other negatives I want. Cap-and-Trade will force homeowners on some form of government "relief" by increasing utility bills by 500-700%. Speaking of Cap-and-Trade, have you noticed how I've marshalled the forces in the wake of that whistle-blower's revelations?? We've {algore and I} always been aware of the possibilities so the justifying authority was repudiating him almost overnight!! {As a sidebar: We're having a bit of trouble with those "tree-huggers" who have seen through the scheme as the "money-grab" that it is. al and I will amass BILLIONS in profits with the sales of carbon credits!!}] That’s why we passed the Recovery Act that cut taxes for 95 percent of working people and for small businesses – and that extended unemployment benefits and health coverage for millions of Americans who lost their jobs in this turmoil. That’s why we are reforming the health care system so that middle-class families have affordable insurance that cannot be denied because of a pre-existing condition or taken away because you happen to get sick. We’ve worked to stem the tide of foreclosures and to stop the decline in home values. We’re making it easier to save for retirement and more affordable to send a son or daughter to college. [What I'm not telling you: The Porkulus Bill is working out just as I planned. I hoodwinked Nancy Porklosi and scarry-harry reid into supporting it, but I had to tell them the primary function-that of a "presidential slush-fund-" to get their support. harry has already seen the benefits when he turned that Landrieu woman into the most expensive "Ho" on the planet!! Those funds, with some accounting slight-of-hand, came from the porkulus bill!!! Neat, huh?? I use it to buy votes and candidates all over the country; "NY-23" ring a bell? The extension of unemployment benefits is working well; more and more Americans on the federal "tit" for longer and longer periods of time. The obamaCare reform bill could have been far more beneficial to you--but far less for me!! If I really had the country's best interests at heart, what would have been far more practical would have been health INSURANCE reform!! The country would have had an almost uncalcuable benefit if health insurance companies were forced to act as auto insurance companies do; with greater competition by allowing interstate sales!! But.... Where would that have left me?? I'd have far less control over your personal lives than I anticipate now!! The rate of foreclosures has fallen simply because we're forcing the banks to just roll the mortgages over-stretching their lengths, but leaving the interest rates intact; we're keeping folks in their homes who can not afford them and have no intention of paying them off; just a ploy to make the numbers look good.] The investments we have made and tough steps we have taken have helped break the back of the recession, and now our economy is finally growing again. But as I said when I took office, job recovery from this crisis would not come easily or quickly. Though the job losses we were experiencing earlier this year have slowed dramatically, we’re still not creating enough new jobs each month to make up for the ones we’re losing. And no matter what the economists say, for families and communities across the country, this recession will not end until we completely turn that tide. So we’ve made progress. But we cannot rest – and my administration will not rest – until we have revived this economy and rebuilt it stronger than before; until we are creating jobs and opportunities for middle class families; until we have moved beyond the cycles of boom and bust – of reckless risk and speculation – that led us to so much crisis and pain these past few years. [What I'm not telling you: The recession is far from over; I contend-privately-that we "ain't seen the worst" yet!! What the Hell do I care; the KoolAiders will re-elect me as long as I keep those tea-party groups and the international whistle-blowers under control. I think the most effective way is what I've done so far; ridiculed them as a viable organization and restricted the use of the National Mall for large gatherings!! All my programs are completely by design!! How's the economy going to recover if I continue to print money, 24/7/365?? How's the economy going to recover if I really push this Asian version of NAFTA that I proposed?? How are the small businesses going to recover if I continue to heap health care and tax expenses on them?? See how my system works?? I have to continue to cloud the issues with my faulty thinking and policies. If I really cared, I'd cut business taxes by 20% across the board, cut individual taxes by 25% and "get government the Hell outta the way!!!" There'd be an economic boom that hasn't been seen since that Reagan fellow!!!] Next week, I’ll be meeting with owners of large and small businesses, labor leaders, and non-for-profits from across the country, to talk about the additional steps we can take to help spur job creation. I will work with the Congress to enact them quickly. And it is my fervent hope – and my heartfelt expectation – that next Thanksgiving we will be able to celebrate the fact that many of those who have lost their jobs are back at work, and that as a nation we will have come through these difficult storms stronger and wiser and grateful to have reached a brighter day. [What I'm not telling you: See how the SEIU, the auto unions and the non-profits and the not-for-profits are always mentioned?? They are fascism's most ardent supporters. They do absolutely nothing to aid in economic recovery, what-so-ever!! They and those thugs in the community agitator organizations keep "the serf class" in line. Any recovery-no matter what sector-is hampered by their activities. Business' attempts at job creation are thwarted by the wage and labor demands put on them by the unions.] Thank you, God bless you, and from my family to yours, Happy Thanksgiving. [What I'm not telling you: That "G-o-d" thing?? I didn't really mean that!!] Til Nex'Time....

This'n'That; November 25th[Liberty-Can We Save It?]

    Ya Know...........??
***I don't work every day; I work part-time, about three or four days for a "big-box" retailer, delivering appliances and building supplies. I have a lot of time now-having been injured in a workplace accident. I've been off for the past 8 or 9 weeks with very limited mobility; I fractured the lateral tibial plateau in my right knee.
***Currently, I have a lot of time to listen to Glenn Beck, Bob Lonsberry and Rush Limbaugh. Even during a normal work week, I listen to each of them about three days a week at home, on work days in the delivery truck when I can. I've often said that I am way to-the-right, politically; somewhere between Limbaugh and Beck!! So far right in fact, that I joined "We Surround Rochester [NY];" one of the organizations to sprout from the summer's nationwide tea parties.
***One of the recent days I was listening to either Beck or Lonsberry and he brought up the Statue of Liberty and the speech President Reagan made on the statue's 100th anniversary. All these talkshows are background "noise" while I paint and repair this double house the "Young Miss Lovely" inherited, so I sometimes miss the details of the broadcast. Well, I missed the point of the "Statue of Liberty" topic so I had to look up some of the information after my day ended.
***What really brought the topic to the fore with me is the country's current political climate. We all know that Fluffy and I will never be "buds," but he's not alone in this trip down the fascist road to "trickle-up poverty." The entire cast of the Congressional Moron Caucus, algore and many, many others are "playing dictator" as well. Look at all the crap that's being foisted upon us; the on-going hoax of global warming/climate change is finally unravelling [ClimateDepot.com], obamaCare is going forward even though just 38% of the public supports the legislation [RasmussenReports.com] and the revelations concerning the global warming hoax should Cap-and-trade a moot point, but that's STILL going forward!!!
***I don't know if yours does, but when I'm doing manual labor, my mind wanders..... A LOT!! My mother said that I "built air castles; My dad- "schemes-and-dreams." In my mind I saw someone with three or four very young children forced to go to great lengths to feed, house and care for his young'uns. I'm quite sure that the average "Mr Someone" is a fine, upstanding and honest individual; but desperate men do desperate things in desperate times!! I can see with the lymphatic domestic and economic policies, without a change in direction and without the addition of educated financial leadership-desperation ain't far off!!
***In my "air castle" the upcoming desperation will cause many-maybe hundreds-of men to assault Liberty Island to strip the statue's pure copper outer sheathing-purely for it's scrap value [$3.12/lb; Dec'008=$1.25/lb]. These commodity prices don't rise just for the fun of it; it's either demand driven-which it's not; there's little manufacturing or home construction to support a 250% increase-or it rises relative to the value of the US Dollar-which it is; the presses have been printing dollars 24/7/365, practically since the "Clown Prince" took office!!
***Now, we come to the Statue of Liberty, herself: A gift from the French citizenry commemorating the centennial of the signing of the US Declaration of Independence. The statue was placed on Liberty Island and dedicated on October 28th, 1886. The bronze plaque with the inscription below IS NOT on the outside of the base as is sometimes depicted; but on the second floor of the pedestal. This is the entire inscription-the bold, italicized portion is the most quoted:
    • Not like the brazen giant of Greek fame,
    • With conquering limbs astride from land to land;
    • Here at our sea-washed, sunset gates shall stand
    • A mighty woman with a torch, whose flame
    • Is the imprisoned lightning, and her name
    • Mother of Exiles.
    • From her beacon-hand
    • Glows world-wide welcome; her mild eyes command
    • The air-bridged harbor that twin cities frame.
    • "Keep, ancient lands, your storied pomp!" cries she
    • With silent lips.
    • "Give me your tired, your poor,
    • Your huddled masses yearning to breathe free,
    • The wretched refuse of your teeming shore.
    • Send these, the homeless, tempest-tossed to me,
    • I lift my lamp beside the golden door!"
***The inscription requires further study; more reflection. My guess is that the average moron would read it as: Send your country's worthless citizens; all the lazy-asses; all the trashy lowlifes, from all the world's third world ratholes to America. We'll "leave the light on" for 'em.......
***What I, being a somewhat above average moron, get from it-as inspired by Glenn Beck-is
    • Send those poor souls to America;
    • Those poor souls you've kept under your boot-heel for generations;
    • Those poor souls who know there is a better life for them, somewhere;
    • Those poor souls who desire nothing but the opportunity to succeed;
    • Those poor souls who desire to demonstrate a work ethic cultivated by starvation;
    • Those poor souls who have been discarded by the ruling class.
My thoughts as well as those of countless millions of others were probably valid from the statue's inception until the early 1930s. The late '20s and early '30s were the birthing ground for the modern era of America's "ruling class."
In 1933, Franklin Roosevelt was elected president on the back of the 1929 stock market crash and the impending depression. Mr Roosevelt's campaign hinged on his promises of returned prosperity.
The FDR presidency's socialist economic policies dramatically extended the length and devestation of the depression. World War II's demand for war materiel was instrumental in ending the economic downturn.
The depression era 'alphabet' programs were nothing more than welfare, with the ruling class gaining the most benefit; the serf class earning "slave wages."
FDR nearly succeeded in reforming the American government from a representative republic to a manarchy. He was the first, last and only president to serve more than two terms. Had he lived, he most probably would have campaigned again and again, until he was defeated.
The modern era of welfare began with the enactment of the Social Security Act in 1935. The act, amended in 1939, established a number of programs designed to provide aid to various segments of the population; unemployment compensation and AFDC are two of the programs that still exist today.
President Johnson's "Great Society" programs continued to support those who decided they didn't need to work, but needed to have more children to increase their benefit checks. The Great Society created the food stamps program; Upward Bound-assistance for high school students; Community Agitation Programs-the probable forerunner of ACORN.
One plank of "Slick-Willie" Clinton's campaign platform was welfare reform. He reformed it, all right!! To make the welfare numbers look better, he transferred many of the recipients to the Social Security give-away programs. Essentially, the number of recipients went UP, NOT DOWN, with may of them drawing social security checks rather than welfare checks.
Those oft-quoted lines on the Statue of Liberty plaque........?? They've evolved to really mean nothing at all!! America is now populated with both legal and illegal immigrants as well as born Americans who choose not to work. We now have the "Clown Prince" who is intent on destroying any liberties left in America:
    • obama started his reign with an on-going "Worldwide Apology Tour, 2009." In a short ten months, he's managed to apologize to most of the world's potentates for The American Spirit and the American's drive for success.
    • obama started and continued to run America into the ground!! The much celebrated Porkulus Bill that was to cure America's ills, is nothing more than a "presidential slush fund."
    • obama has two programs near and dear to his heart which will accomplish his primary goal. He and the Congressional Moron Caucus are promoting govenment takeover of 18% of the American economy through health care reform.
    • In June, the House Moron Caucus passed the Cap-and-Tax bill [H.R.2454] which even "the tree-huggers" see as a corporate MONEY-GRAB!! Both of these pieces of moronic legislation do nothing more than feed his desire to destroy the serf class in America.
    • These blatant attempts at wealth redistribution do nothing more than reduce the American standard of living to that of most third-world ratholes he admires, but won't live in one.
    • The "Clown Prince" demonstrates daily, his distain for the military of the United States. It's now taken him nearly six months to decide what to do militarily in Afganistan. His chosen general in charge, Stanley McChrystal needed 40 to 80,000 troops back in July-so the clown decides he'll authorize 34,000 troops!! And that's OVER THE COURSE OF THE NEXT YEAR!!! What dam' good is that?!?!?!
Almost daily since the "Clown Prince" reign-of-power began, our liberties have been eroded!! If it's not the "Clown" himself, it's Nancy Porklosi or Scarry-harry reid or Chuckie-Cheese Schumer or Geeze-Louise McIntosh Rodham Slaughter or any number of others in the Congressional Moron Caucus!!! Ya know what the "Hell of it" is.....?? All these morons have grown to believe they're entitled to their positions as members of the ruling class!! Practically everything done sofar, amount to several impeachable offenses...... When are the hearings going to start??? A better question might be when will the "Clown Prince" and the Congressional Moron Caucus going to uphold their oaths of office??
I'm pissed off and I never intend to vote for an incumbent, ever again!!!

Maybe America 'Should....' Fluffy obama, during the Asian leg of his International Apology Tour-2009, is suggesting that America be more like European and Asian socialist ratholes. "Suggesting," Hell..... with the fascist directions he's taking the country, we'll out-socialist the socialists!!! In some cases, I agree with him.....Ugh!! That was tough to write!!! ACLU aside, I'm thinking that we align American justice and punishment practices more with the Chinese. No more prisoners languishing in American prisons with access to cable TV, air conditioning, exercise machines, free weights, exercise yards, gourmet foods, junk food, visitation, drugs, etc. All this costs many thousands of dollars per prisoner-per year, with no appreciable, positive affect. Meanwhile, those sentenced to death, hang-out in the justice system for 20-30 years, exhausting appeal after appeal. I'm suggesting that we follow Fluffy's lead and try to be more like socialist China. The meer word: "socialist" will move the concept past the ACLU!! Remember that "tainted milk powder scandal" in China? Well, after a short wait [by American standards], two guys were executed were executed and about twenty others recieved lengthly prison sentences!! Those two that were executed....?? One was convicted of "endangering public safety" and the other convicted of "producing and selling toxic food."
The two dead guys were adulterating infant formula with the industrial chemical melamine, which can cause kidney stones and kidney failure. Melamine, used in the manufacture of plastics and fertilizer, was added to watered-down milk to fool inspectors testing for protein, and to boost profits.
In America, imagine the drastic and immediate reduction in the rape and murder statistics, not to mention many other lesser crimes!! Hell, what if we could get this type of discipline applied to the 535 members of the Congressional Moron Caucus..... maybe even
    • legislation in plain english
    • legislative lead times to allow the public scrutiny
    • the end of: one legislator [reid?] prostituting another [Landrieu?]
    • the end of the "ruling class" lording their power over we of the "serf class"
That "endangering public safety" thingie..... that reminds me of all the morons we see on America's highways, merrily driving along-talking and texting on their cellphones, repairing or plastering on-their makeup, shaving, using laptops, eating breakfast, et al!! If that ain't "endangering public safety...." I don't know what is!!! These highway morons alone, will insure the "lethal injection" market remains alive and well--forever!!! Algore;"ClownPrince;" Congressional Moron Caucus-FRAUDS, All!! [I found this article at http://www.minnesotansforclobalwarming.com/ ] Al Gore Wishes He Never Invented The Internet By Elmer Beauregard It used to be a lot easier for people in power like Al Gore to control peoples opinions. Not too long ago if you said something stupid on national TV it was no big deal, just a phone call to a couple of big newspapers and the story went nowhere. But now if you say anything wrong at all:
    • like the earth's core is several million degrees instead of several thousand degrees, all the little bloggers with no credentials jump all over it and make a big deal about it.
    • Or when Senator John Kerry [who served in Viet Nam], in explaining the need for a climate change bill, noted that in "the last eight years emissions in the United States of America in greenhouse gasses went up four times faster than in the 1990s" when in actuality they went down in that time period. In the olden days the press would just take Kerry's word as gospel.
And now with the release of the leaked emails from AirVent.com I bet Al Gore Wishes he never would have invented the internet. The Global Warming Extremists had a good thing going for a while. All it took was one U.N. entity, a few scientists, a few scientific journals, one chart based on one tree, one politician and his documentary plus the main stream media, and Voilà! You have a worldwide crisis that requires a worldwide tax and a worldwide government. It will take a long time to decipher what was said in these emails but here is one of my personal favorites, so far:
If McIntyre had a legitimate point, he would submit a comment to the journal in question. of course, the last time he tried that (w/ our '98 article in Nature), his comment was rejected. For all of the noise and bluster about the Steig et al Antarctic warming, its now nearing a year and nothing has been submitted. So more likely he won't submit for peer-reviewed scrutiny, or if it does get his criticism "published" it will be in the discredited contrarian home journal "Energy and Environment". I'm sure you are aware that McIntyre and his ilk realize they no longer need to get their crap published in legitimate journals. All they have to do is put it up on their blog, and the contrarian noise machine kicks into gear, pretty soon Druge, Rush Limbaugh, Glenn Beck and their ilk (in this case, The Telegraph were already on it this morning) are parroting the claims. And based on what? some guy w/ no credentials, dubious connections with the energy industry, and who hasn't submitted his claims to the scrutiny of peer review.
The Global Warming Extremists controlled the argument for years by saying, it's only legitimate science if it's published in certain journals and peer reviewed, and if you control the Journals you control the science. But sadly with Al Gore's invention, the anointed few are losing control, much like churches did with the invention of the printing press. "Clown Prince" Weekly Blather; 11/21 [A Patriotic Response to the "Clown Prince, November 21, 2009] Weekly Address Saturday, November 21, 2009 Hi. I’m recording this message from Seoul, South Korea, as I finish up my first presidential trip to Asia. As we emerge from the worst recession in generations, there is nothing more important than to do everything we can to get our economy moving again and put Americans back to work, and I will go anywhere to pursue that goal. That’s one of the main reasons I took this trip. Asia is a region where we now buy more goods and do more trade with than any other place in the world – commerce that supports millions of jobs back home. It’s also a place where the risk of a nuclear arms race threatens our security, and where extremists plan attacks on America’s soil. And since this region includes some of the fastest-growing nations, there can be no solution to the challenge of climate change without the cooperation of the Asia Pacific. [What I'm not telling you: This is the Asian leg of my "World-wide Apology Tour-2009." We're continuing farther into a deepening recession....NOT coming out of one!! With U-3 unemployment just under 10.5%; the U-6 unemployment crossing the 17% threshold, it should be as obvious "as the nose on your face" that the NAFTA accord is continuing to trash the American economy; far more devastating than H. Ross Perot warned us about [You remember that "Sucking Sound...." phrase he used--a sound that REALLY SUCKS now that some regional unemployment rates are approaching 20%!!] With this in mind, I traveled to Asia to open a new era of American engagement. We made progress with China and Russia in sending a unified message to Iran and North Korea that they must live up to their international obligations and either forsake nuclear weapons or face the consequences. As the two largest consumers and producers of energy, we developed a host of new clean energy initiatives with China, and our two nations agreed to work toward a successful outcome at the upcoming climate summit in Copenhagen – an outcome that leads to immediate action to reduce carbon pollution. And I spoke to young men and women at a town hall in Shanghai and across the internet about certain values that we in America believe are universal: the freedom of worship and speech; the right to access information and choose one’s own leaders. [What I'm not telling you: During my 142 DAYS of senatorial experience, I actively supported the position that anything detrimental to American interests were beneficial to my future plans for trashing the United States. This has been a particularly successful leg of my tour in two areas: Domestically; the international talks supporting the blatently false premise of global warming, will have horribly negative affects on Americans by raising their utility bills by 10-fold OR MORE!! Internationally; I've started initial talks with the objective of having a NAFTA-type agreement with the Asian countries that will continue the economic devastation the U.S. is currently experiencing. The more Americans I can force to follow the welfareRATs into government dependence, the closer to total fascism we'll be!! That "town hall" thingie..... I had to say crap like that to keep my hook into the KoolAid Drinkers at home.... What to Hell do I care about free elections, freedom of speech and religion or access to the internet?? The public in every nation including America, will swallow all that horseshit... even as I strive to limit their freedoms!!] But above all, I spoke with leaders in every nation I visited about what we can do to sustain this economic recovery and bring back jobs and prosperity for our people – a task I will continue to focus on relentlessly in the weeks and months ahead. This recession has taught us that we can’t return to a situation where America’s economic growth is fueled by consumers who take on more and more debt. In order to keep growing, we need to spend less, save more, and get our federal deficit under control. We also need to place a greater emphasis on exports that we can build, produce, and sell to other nations – exports that can help create new jobs at home and raise living standards throughout the world. [What I'm not telling you: I don't believe that "economic recovery" crap any more than you do; it just sounds good when I talk with the other fascists. See how I can talk "out of both sides of my mouth??" Consumers taking on more debt.... that's the only way they can spend!! I've constricted the economy so bad-there's no money left THAT I DON'T CONTROL!! Getting our deficit under control..... Some Americans are realizing that while I talk about that, I continue to increase the deficit exponentially. Most though, are buying my "fluffy math" where I tell them that spending ONE TRILLION DOLLARS on obamaCare will actually reduce the deficit... I can't believe how stupid the KoolAid Drinkers are!!! "....a greater emphasis on exports we can build, blah, blah,....." See how, in the midst of trashing the economy, I try to convince you that there REALLY IS a manufacturing base left in the country?? This will create new jobs at home?? How, with very few current jobs to build upon?? Some of those "Palin Conservatives" have figured out how I intend to generate equality in worldwide living standards. Rather than raise the standards in those third-world ratholes, I intend to lower American standards to achieve parity!!] For example, if we can increase our exports to Asia Pacific nations by just 5%, we can increase the number of American jobs supported by these exports by hundreds of thousands. This is already happening with businesses like American Superconductor Corporation, an energy technology startup based in Massachusetts that’s been providing wind power and smart grid systems to countries like China, Korea, and India. By doing so, it’s added more than 100 jobs over the last few years. [What I'm not telling you: I realize that the Asian countries manufacture the vast majority of the worthless crap that retailers like Walmart import, I may have to work to convince you that our exports to those countries can be increased by 5%!! That technology company's exports to Asia... How long do you think it'll take for China to be making it's own knock-offs?? And there goes those 100 jobs, "right out the window!!" International patent and intellictual property laws mean nothing to them.... If they can't pay ya off; they tie any lawsuits up in the courts for years and years, til ya give up!! The country of China has ahelluva lot more money than any American individual or company has!!!] Increasing our exports is one way to create new jobs and new prosperity. But as we emerge from a recession that has left millions without work, we have an obligation to consider every additional, responsible step we can take to encourage and accelerate job creation in this country. That’s why I’ve announced that in the next few weeks, we’ll be holding a forum at the White House on jobs and economic growth. I want to hear from CEOs and small business owners, economists and financial experts, as well as representatives from labor unions and nonprofit groups, about what they think we can do to spur hiring and get this economy moving again. [What I'm not telling you: Creating new jobs: How the Hell is that even possible with the manufacturing and service bases decimated?? Another boon to fascism is the tax structure; virtually no one can create new businesses or expand existing ones, when the federal tax scheme is constantly working against them... again, more and more suckling at the government tit-government dependency!!! Not only is nearly 18% of the population DEPENDENT ON ME, this continuing recession is generating more recipients of government largess!! Not only are they dependent upon the government for their very sustenance, I'm slowly destroying their will to work--to strive for success!! Notice how this impending "forum" will only be attended by my supporters; those with thoughts of the success of fascism?? Labor union reps and non-profits....?? I depend on those thugs for my political existence, so they're the ones I'll appease FIRST!!] It is important that we do not make any ill-considered decisions – even with the best of intentions – particularly at a time when our resources are so limited. But it is just as important that we are open to any demonstrably good idea to supplement the steps we’ve already taken to put America back to work. That’s what I hope to achieve in this forum. [What I'm not telling you: "....ill-considered decisions.." Practically every decision I've made since I bought the presidency has been ill-considered; Porkulus, TARP, obamaCare, cap-and-tax, etc. Porkulus-that's just a mis-named "slush-fund" I can use to buy future offices; a second term, the Secretary-Generalship of the UN, putting other fascists in federal elective office, etc. TARP; a fund I can use to reward my friends and supporters-those who guide American business and industry along fascist lines. obamaCare; thatwill be a two-fold benefit for me, controlling nearly 20% of the American economy as well as lowering the American standard of living to a point closer to those third-world ratholes I idolize!! Cap-and-tax, again will further reduce the American standard of living through enormous utility expenses for every American!!] Still, there is no forum or policy that can bring all the jobs we’ve lost overnight. I wish there were, because so many Americans – friends, neighbors, family members – are desperately looking for work. But even though it will take time, I can promise you this: we are moving in the right direction; that the steps we are taking are helping; and I will not let up until businesses start hiring again, unemployed Americans start working again, and we rebuild this economy stronger and more prosperous than it was before. That has been the focus of our efforts these past ten months – and it will continue to be our focus in the months and years to come. [What I'm not telling you: The jobs that I've forced to "go away...." They'll probably never return-at least during my administration!! Fascism can not succeed without control of the individual; Dependence on the federal government for income is the greatest control ever concieved!! The focus of our efforts the last ten months has been to initiate the average American to fascism-and my trashing of the economy worked beyond my wildest dreams!! We now have a large portion of the populus feeling downtrodden and open to the next phase: government dependence!! Our focus will continue to be fascist indoctrination and government dependence, so "hang-in-there" all you KoolAiders!!!] Thanks.

    This'n'That; November 20th[Payola;Lyin'Bastards]

In Business:Illegal; In Congress:Legal [William Jefferson got 13 years jail time for accepting $90,000 in bribes while serving in the House of Representatives [from Louisiana, how ironic!!]. Vernon L. Jordan got 7 years in the "Gray-Bar Hotel" for a $400,000 bribe to Jefferson. But the guy in the photo above.... the guy who's showing you what he's gonna do to you with the obamaCare bill currently in the senate,is doing the same thing!!! harry reid is bribing Senator Mary Landrieu [d,La], with $100,000,000 written into the obamaCare bill that ONLY APPLIES to the State of Louisiana. Due to the incredible political corruption in Louisiana and to a lesser degree, the Hurricane Katrina devastation, Louisiana can't pay it's medicaid bill. If the state doesn't have it's Medicaid money; most of it's residents will have to go to work rather than continuing to suckle at the government tit and watching OUR TVs!!! Can we expect that slimeball, Eric Holder to go into the senate chambers, guns ablazin' and put that crooked sum'bitch reid in handcuffs?? S-U-R-E!!! We have as much chance of that as we do, expecting the "Clown Prince" to denounce fascism!!!]
On page 432 of the Reid bill, there is a section increasing federal Medicaid subsidies for “certain states recovering from a major disaster.” The section spends two pages defining which “states” would qualify, saying, among other things, that it would be states that “during the preceding 7 fiscal years” have been declared a “major disaster area.” The section applies to exactly one state: Louisiana, the home of moderate Democrat Mary Landrieu, who has been playing hard to get on the health care bill. In other words, the bill spends two pages describing would could be written with a single world: Louisiana. (This may also help explain why the bill is long.) senator harry reid, who drafted the bill, cannot pass it without the support of Louisiana’s Mary Landrieu. How much does it cost? According to the Congressional Budget Office: $100 million.
    Here’s the incredibly complicated language:
    • SEC. 2006. SPECIAL ADJUSTMENT TO FMAP DETERMINATION FOR CERTAIN STATES RECOVERING FROM A MAJOR DISASTER.
    • Section 1905 of the Social Security Act (42 U.S.C. 1396d), as amended by sections 2001(a)(3) and2001(b)(2), is amended— (1) in subsection (b), in the first sentence, by striking ‘‘subsection (y)’’ and inserting ‘‘subsections (y) and (aa)’’; and (2) by adding at the end the following new subsection:‘‘(aa)(1) Notwithstanding subsection (b), beginning January 1, 2011, the Federal medical assistance percentage for a fiscal year for a disaster-recovery FMAP adjustment State shall be equal to the following:
    • ‘(A) In the case of the first fiscal year (or part of a fiscal year) for which this subsection applies to the State, the Federal medical assistance percentage determined for the fiscal year without regard to this subsection and subsection (y), increased by 50 percent of the number of percentage points by which the Federal medical assistance percentage determined for the State for the fiscal year without regard to this subsection and subsection (y), is less than the Federal medical assistance percentage determined for the State for the preceding fiscal year after the application of only subsection (a) of section 5001 of Public Law 111–5 (if applicable to the preceding fiscal year) and without regard to this subsection, subsection (y), and subsections (b) and (c) of section 5001 of Public Law 111–5.
    • ‘‘(B) In the case of the second or any succeeding fiscal year for which this subsection applies to the State, the Federal medical assistance percentage determined for the preceding fiscal year under this subsection for the State, increased by 25 percent of the number of percentage points by which the Federal medical assistance percentage determined for the State for the fiscal year without regard to this subsection and subsection (y), is less than the Federal medical assistance percentage determined for the State for the preceding fiscal year under this subsection.
    • ‘‘(2) In this subsection, the term ‘disaster-recovery FMAP adjustment State’ means a State that is one ofthe 50 States or the District of Columbia, for which, at any time during the preceding 7 fiscal years, the President has declared a major disaster under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act and determined as a result of such disaster that every county or parish in the State warrant individual and public assistance or public assistance from the Federal Government under such Act and for which—
    • ‘‘(A) in the case of the first fiscal year (or part of a fiscal year) for which this subsection applies to the State, the Federal medical assistance percentage determined for the State for the fiscal year without regard to this subsection and subsection (y), is less than the Federal medical assistance percentage determined for the State for the preceding fiscal year after the application of only subsection (a) of section 5001 of Public Law 111–5 (if applicable to the preceding fiscal year) and without regard to this subsection, subsection (y), and subsections (b) and (c) of section 5001 of Public Law 111–5, by at least 3 percentage points; and
    • ‘‘(B) in the case of the second or any succeeding fiscal year for which this subsection applies to the State, the Federal medical assistance percentage determined for the State for the fiscal year without regard to this subsection and subsection (y), is less than the Federal medical assistance percentage determined for the State for the preceding fiscal year under this subsection by at least 3 percentage points.
    • ‘‘(3) The Federal medical assistance percentage determined for a disaster-recovery FMAP adjustment State under paragraph (1) shall apply for purposes of this title (other than with respect to disproportionate share hospital payments described in section 1923 and payments under this title that are based on the enhanced FMAP described in 2105(b)) and shall not apply with respect to payments under title IV (other than under part E of title IV) or payments under title XXI.’’.

    • Representative "Baby" Slaughter (D-NY) celebrates today. The co-chair of the Pro Choice Caucus knows taxpayer funded abortions survived and is in the bill. Her nemesis and the hero of this story, Bart Stupak (D-MI) still fights to ensure tax payers aren't going to be forced to pay to "slaughter" babies through abortion.
    • Line 7, p. 118, section 1303 under “Voluntary Choice of Coverage of Abortion Services” gives the Health and Human Services Secretary the authority of when abortion is covered in the Senate bill. harry reid's Senate Bill requires on insurance coverage plan to cover abortions.
    • Line 11, page 122, section 1303, under “Actuarial Value of Optional Service Coverage” creates a fund in the Treasury to pay for abortions. Part of these fees will be paid from the minimal premiums that will be charged for the government plan.
    • Section 1303(a)(2)(C) says that a minimum of a $1 a month will be added to the premium to provide abortion coverage. Of course there is a subsidy for those who can't afford the dollar premium. It's called the affordability credit, which means many women won't be paying for their abortions all all--taxpayers will.
    • This may be the one issue that divides Congress. obama made the promise he would not approve of a healthcare plan that will include federal funding of abortion, but like most things obama says, you only take it with a grain of salt. Still, there will be pressure on him from both sides. There are democRATs threatening to vote against it if it includes abortion coverage, and there are democRATs who are threatening to vote against it if it excludes abortion coverage. Let's hope this is the issue that defeats this bill.
    • Call your Senator today. Hey Claire McCaskill, this bill isn't deficit neutral. I expect you to live up to your promise and vote against it, but I know you lied to your constituents.

    This'n'That; November 19th[D-3;DeathPanel;ACORN;Audacity]

New York State Legislators: THIEVES!! Guvner "Double-Dealin' Dave" Paterson [or D-3, or Dave-The-Turd], keeps summoning the state's ruling class back to Albany for a special session to try and "stop the bleeding!!" They have the testicular fortitude to accept payment for their attendence!!
    • Remember: These are the same arschlocher that have been paid for each and every appearance in Albany
    • Remember: These are the same arshlocher that shut down the state government over some childish drivel.
    • Remember: These are the same arshlocher that could have taken up the budget many, many times during their regular session.
    • Remember: These are the same arshlocher that are being paid TWICE to do their jobs JUST ONCE. By accepting their pay and expense checks, they are in affect, stealing from the same state treasury they've already depleted!!
Where's "Dave-the-Turd" on this phenomonon?? Probably hiding under his desk, hoping no one'll yell at him!! I'd lock the bastards out and order the state's treasurer NOT to issue their checks!! Death Panels Now In Effect! Sarah Palin warned us they were coming, but did we listen?? N-o-O-O-o!!
The U.S. Preventive Services Task force (USPSTF), funded by the Agency for Healthcare Research and Quality, published its recommendations in Annals of Internal Medicine; its decision was based on an analysis of existing trials that looked at the impact of mammography on breast-cancer deaths. The task force further recommended that women between ages 50 and 74 get screened every two years instead of annually, and that doctors no longer urge women to conduct monthly breast self-exams, since the practice does not appear to significantly reduce the risk of death from breast cancer. When this was first reported Tuesday, Bob Lonsberry--on his "Mid-day Talk Show" [weekdays, 11AM-2PM, WHAM radio, 1180AM; www.lonsberry.com ]--fielded dozens of calls on the topic. Many women reported that they'd discovered their own breast cancers between ages 40 and 50; others as young as early-to-mid thirties!! Ladies, how do you think your insurance carrier will take this news?? I'm sure they'll see it as a way to boost profits, as is normal in any for-profit business. "The government says these exams are no longer necessary at this early age, so we're not going to cover them until the insured reaches the recommended age." What a loada horseshit!! What's the value of a human life?? The "Clown Prince" seems to think--NOT MUCH!! If earlier exams prevent just one death, then the nation-wide expense of earlier mammographies are well worth the cost!! This is nothing more than a possible death sentence to those women who aren't checked at the previous standard age!!

How's that "hope-and-change" workin' for ya, now?!?!?!

An Important Story: Rep. Steve King: Bauer was hired to 'erase tracks' between Obama, ACORN By Tony Romm, The Hill

Newly appointed White House counsel Bob Bauer is "perfectly positioned to be tasked with erasing the tracks between Obama and ACORN," one Republican lawmaker charged Friday. The lawyer's hiring, announced this morning shortly after Greg Craig officially resigned the post, was also an attempt by the White House to deflect any fallout that may arise from an ACORN investigation currently underway in Louisiana, Rep. Steve King (R-Iowa) added in a statement. "Bob Bauer has a public record of defending barack INSANE obama's [Mm...Mm...Mm!!] relationship with ACORN, the congressman told supporters. "Bauer's hiring appears to be a tactical maneuver to strategically defend the White House exactly one week after Louisiana Attorney General Buddy Caldwell raided ACORN's national headquarters in New Orleans and seized paper records and computer hard drives that may lead to the White House." However, the link between Bauer, the president and ACORN's Louisiana office is long, winding and confusing, at best. Read the Rest of the Story:

    Another Important Story:

The audacity of extremism By James Lewis, American Thinker

Audacity is supposed to be a talent in great generals -- at least some of them. That's where the phrase comes from: "L'audace, l'audace, toujours l'audace!" It's attributed to the Kaiser Friedrich der Grosse, to Georges Danton, (one of the big head-choppers of the French Revolution), and to Napoleon Bonaparte. Audacity can be effective in warfare, because surprise assaults can break through a Maginot Line. But another word for audacity is "gambling." The price you often have to pay is overreach and defeat. Napoleon's audacity led straight to an historic defeat for Imperial France in Russia. France never recovered--it's had two straight centuries of military defeats since Napoleon. His invasion of Russia also caused unimaginable suffering, just like Hitler's invasion a century later. Audacity is not necessarily a good thing. When Obama uses the phrase "The Audacity of Hope," we hope he's talking about peaceful audacity. But we can't be sure--because Obama and his inner circle are extremists in any reasonable meaning of that word, certainly by the standards of normal American politics. That's why Obama seems so foreign. That is what "radical" means; it's another word for "extremist." These folks love to preen themselves on being radical. Rules for Radicals is their Bible, and it's Obama's manual for "community organizing" -- which looks just like community destruction. Alinsky dedicated Rules for Radicals to Lucifer, because Lucifer is the symbol of destructive extremism. Don't tell me these folks are mainstream Americans. No way. Read the Rest of the Story:

KoolAiders--Did you know these things when you voted for the "Clown Prince??"
